New 401K Fiduciary Rules – Protecting Future Assets

The Employee Retirement Income Security Act (ERISA), enacted in 1974, protects the individual’s tax-preferred retirement savings. Over the last 40 years, legislation surrounding ERISA has been altered that would continue to safe-guard Individual Retirement Accounts (IRAs) and annuities. The latest amendment by the Department of Labor (DOL), passed on April 6, comes on the heels of debate among analysts as to the detriment it could have on insurance providers. However, many are regarding this ruling as an imperative step to maintaining the government’s promise to shield investors’ funds and protect against loss of assets. Though still being evaluated, Congress has opted to implement new 401K fiduciary rules effective April of 2017 that better define the act of the financial advisor, and seeks to implement parameters around the business of selling retirement plans and investments.
