How to separate what's TRUE from what could be a costly mistake. The IRS and U.S. Department of Labor are more vigilant than ever about enforcing proper employee classification. That means it is absolutely critical to correctly categorize your crew members as either independent contractors or part-time employees in order to adhere to regulatory guidelines and avoid penalties. According to the U.S. Department of Labor, "misclassification" refers to a worker who is an employee under the law, but the individual is inaccurately classified as something other than an employee.
